Disclosure by Prosecutor (including Police) in criminal trials

Interesting to note in yesterday's The West Australian newspaper that disclosure is an issue in the high profile Rayney murder case which is due to go to trial in May. Non-disclosure by police was certainly a matter in the WA Mallard matter and was commented on subsequently by the High Court. The issue of non-disclosure is an area that is of particular interest in possible miscarriage of justice matters and a topic that I will be researching as to jurisdictional-specific and common law requirements. Watch this space!

Developments in Australia re a Criminal Case Review Commission

Interesting to note from the Networked Knowledge website netk.net.au that SA is considering a Review Commission along the lines of the one which exists in the UK. An SA Parliamentary Legislative Review Committee is currently considering the matter. The UK body is an independent public body set up to investigate possible miscarriages of justice. The Commission assesses whether convictions or sentences should be referred to a court of appeal. See www.ccrc.gov.uk. This initiative seems to provide an option of last resort to innocent people who have exhausted all other avenues.

WA Innocence Project

The WA Innocence Project "IPWA" was founded in 2006. It lists the causes of miscarriages of justice as: false confessions, media bias and political pressures, police/prosecution misconduct, eyewitness misidentification, forensic errors and informants. Website launched!

The official website for BEtter Consulting went live on Friday 27 January 2012. It is hoped that the content and "feel" of the site will communicate what is hoped to be achieved through the new concept of an integrity and justice consultancy role. Hope to be able to reflect on some significant milestones and achievements in 12 months time.
